These Terms of Sale apply to purchases made on the Wayke online store.

The terms “Wayke”, “we”, “us” and “our” refer to Wayke, operated by Alex Hug, entrepreneur individuel (EI), micro-entrepreneur, registered in France.

By placing an order on our website, you agree to these Terms of Sale. Please read them carefully before purchasing.

These Terms do not limit any mandatory consumer rights that apply to you under French, European Union, United Kingdom, or other applicable consumer protection laws.

2. Scope

These Terms of Sale apply to all orders placed by consumers through the Wayke website.

The products sold on the website are intended for personal and household use only. They may not be purchased for unauthorized resale, commercial distribution, or export.

3. Products

Wayke sells wellness and lifestyle products, including nasal strips and wearable sleep-related accessories.

We make reasonable efforts to describe and display our products accurately. However, product images, colors, size perception, packaging, or appearance may vary slightly depending on your screen, device settings, production batch, or supplier updates.

Product descriptions, prices, and availability may change at any time. We may discontinue or limit the availability of any product where necessary.

Wayke products are wellness products. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Results may vary from person to person.

If you have breathing difficulties, sleep apnea, skin sensitivity, allergies, a medical condition, or any concern about using one of our products, consult a healthcare professional before use.

Nasal strips are for external use only. Do not apply them to broken, irritated, sunburned, or sensitive skin. Stop use if irritation, discomfort, redness, or any adverse reaction occurs.

Wearable sleep accessories must be used only as instructed. Do not rely on them for emergency alerts, medical monitoring, or critical alarms.


4. Prices

Prices are shown on the product pages and at checkout in the applicable currency.

The final price, including applicable taxes and shipping charges where available, is shown before you confirm your order.

Prices, discounts, bundles, and promotions may change at any time without notice. The price charged will be the price shown at checkout when you place your order.

Unless stated otherwise, discount codes cannot be combined with other offers, bundles, or promotions.


5. Taxes, Customs, and International Orders

For orders shipped outside France or outside the European Union, including to the United Kingdom, customs duties, import taxes, VAT, brokerage fees, or other charges may apply depending on the destination country, order value, and local rules.

Where taxes, duties, or import charges are collected at checkout, this will be shown before payment.

Where such charges are not collected at checkout, they may be charged directly to the customer by customs authorities, postal services, or carriers. The customer is responsible for any such charges unless applicable law requires otherwise.

For UK customers, VAT and customs treatment may depend on the order value, destination, and whether VAT is collected at checkout. Customers are responsible for checking any import charges that may apply before placing an order.


6. Payment

Payment is due at the time of order.

Accepted payment methods are shown at checkout. We may use third-party payment providers to process payments securely.

By providing payment information, you confirm that you are authorized to use the selected payment method and that the information provided is accurate.

We may refuse or cancel an order if payment is refused, suspected to be fraudulent, incomplete, or otherwise invalid.


7. Order Confirmation

When you place an order, you are making an offer to purchase the selected product or products.

Your order is accepted once we confirm it by email and payment has been processed.

After placing an order, you will receive an order confirmation by email. Please check the order confirmation carefully and contact us as soon as possible if there is an error.

We may be unable to cancel or modify an order once it has been processed, packed, or shipped.

We reserve the right to refuse, cancel, or limit an order where necessary, including in cases of suspected fraud, incorrect pricing, product unavailability, payment issues, incorrect customer information, or breach of these Terms.


8. Shipping and Delivery

Shipping options, costs, and estimated delivery times are shown at checkout or on our Shipping Policy page: 

Delivery times are estimates unless expressly stated otherwise. We will make reasonable efforts to deliver orders within the timeframe shown at checkout or, if no timeframe is provided, within the timeframe required by applicable law.

Delivery delays may occur due to carrier delays, customs processing, incorrect shipping information, strikes, weather, supply issues, high order volume, or other events outside our reasonable control.

The customer is responsible for providing a complete and accurate shipping address. If an order is delayed, lost, returned, or delivered incorrectly because the customer provided incorrect or incomplete information, additional shipping costs may apply.

For consumer orders, risk of loss or damage passes to the customer when the customer, or a person designated by the customer other than the carrier offered by us, physically receives the goods.

9. Right of Withdrawal

If you are a consumer located in France, the European Union, the United Kingdom, or another country that grants cancellation rights for distance purchases, you may have the right to withdraw from your order within 14 days after receiving the goods, without giving a reason.

To exercise your right of withdrawal, you must inform us clearly before the end of the withdrawal period.

You may use the model withdrawal form included at the end of these Terms, but it is not mandatory.

From 19 June 2026, where required by French law, consumers must also be able to exercise their right of withdrawal directly online through a clear and easily accessible withdrawal function. Once available, this function will be accessible here: 

If you use the online withdrawal function, we will send you an acknowledgement of receipt on a durable medium, such as email.


10. Exceptions to the Right of Withdrawal

Certain products may not be eligible for withdrawal or return where an exception applies under consumer protection law.

For hygiene and health protection reasons, sealed products that are not suitable for return may not be returned once they have been opened, unsealed, used, damaged, or made unsuitable for resale.

This may apply to nasal strips and other personal-use hygiene products once opened or unsealed.

This does not affect your rights if the product is defective, damaged, or not in conformity with the contract.


11. Return Conditions

If you exercise your right of withdrawal, you must return the product within 14 days after informing us of your decision to withdraw, unless we agree otherwise.

Products should be returned unused, unopened where applicable, complete, and in their original packaging where possible.

Before sending a return, contact us at hello@wayke.store with your order number so we can provide return instructions.

Return address: TO BE PROVIDED AFTER RETURN REQUEST Unless we state otherwise or applicable law requires otherwise, return shipping costs are the customer’s responsibility.

The customer is responsible for the condition of the returned product until it is received by us. We recommend using a tracked shipping method.


12. Refunds

If you validly exercise your right of withdrawal, we will refund the eligible amount using the same payment method used for the original transaction, unless another method is agreed.

We may withhold the refund until we have received the returned goods or until you provide proof that the goods have been shipped back, where permitted by law.

Original standard delivery costs may be refunded where required by law. Additional costs for express, premium, or upgraded shipping options may not be refunded unless required by applicable law.

If returned products are used, opened where hygiene rules apply, damaged, incomplete, or reduced in value due to handling beyond what is necessary to inspect them, we may reduce the refund where permitted by law.


13. Damaged, Defective, or Incorrect Products

If you receive a damaged, defective, or incorrect product, contact us at hello@wayke.store as soon as possible with:

  • your order number;

  • a description of the issue;

  • photos or videos showing the issue where relevant.

If the product is defective, damaged, or not in conformity with the contract, we will provide a solution in accordance with applicable law. This may include replacement, repair, refund, or another appropriate solution.

Nothing in these Terms limits your mandatory legal rights.


14. Legal Guarantees

For consumers, products are covered by mandatory legal guarantees where applicable, including the legal guarantee of conformity and the guarantee against hidden defects.

Under the legal guarantee of conformity, the seller must deliver goods that conform to the contract.

For new goods sold to consumers in France and the European Union, the legal guarantee of conformity generally applies for two years from delivery.

If a product is not in conformity, the consumer may be entitled to repair, replacement, price reduction, or refund, depending on the situation and applicable law.

The seller is responsible for the legal guarantee of conformity. The customer does not have to contact the manufacturer directly to exercise this right.

These legal guarantees apply independently of any commercial warranty that may be offered.


15. Subscriptions

Some Wayke products may be offered as subscriptions, including “subscribe and save” offers.

If you purchase a subscription, you authorize Wayke and its payment providers to charge your selected payment method on a recurring basis according to the price, billing frequency, delivery frequency, and terms shown at checkout.

The exact subscription details are shown before purchase and may include:

  • the subscription product;

  • the recurring price;

  • the billing frequency;

  • the delivery frequency;

  • any subscription discount;

  • how to manage or cancel the subscription.

Subscriptions renew automatically until cancelled, unless stated otherwise at checkout.

You can manage or cancel your subscription through the customer portal, subscription management link, customer account, or by contacting us at hello@wayke.store.

For French consumers, where a subscription can be concluded online, an online cancellation function must be made available through the website or customer area. This function must be clear, easy to access, and presented with wording such as “Cancel your subscription” or “Résilier votre contrat”.

Cancellation stops future renewals. It does not automatically cancel or refund an order that has already been billed, processed, or shipped, unless required by law or permitted under our Refund Policy.

If a subscription payment fails, we or our subscription provider may retry the payment, notify you, pause the subscription, or cancel it according to the subscription settings and applicable law.

Wayke may change subscription prices, products, or terms in the future. If such changes affect an active subscription, we will notify customers where required by law.


16. Discount Codes, Bundles, and Promotions

We may offer discount codes, bundles, limited-time promotions, free shipping offers, or subscription discounts.

Promotions are valid only under the conditions stated at the time of the offer. They may be changed, suspended, or ended at any time unless otherwise stated.

Discounts may not be applied retroactively to past orders.

If a promotion contains an error, we may correct the error or cancel the affected order where permitted by law.


17. Customer Obligations

The customer agrees to provide accurate order, shipping, billing, and contact information.

The customer agrees not to misuse the website, place fraudulent orders, interfere with the operation of the store, or purchase products for unauthorized resale.

The customer is responsible for reading product instructions, warnings, and usage guidelines before using the products.


18. Liability

Wayke is responsible for fulfilling its obligations under these Terms and applicable consumer law.

However, to the fullest extent permitted by law, Wayke is not liable for indirect losses, loss of profits, loss of opportunity, or damages resulting from misuse of the products, failure to follow instructions, or events outside our reasonable control.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for mandatory consumer rights, defective products, fraud, intentional misconduct, or death/personal injury caused by negligence where applicable.


19. Personal Data

Personal data collected during ordering and customer service is handled according to our Privacy Policy: 

Because the store is powered by Shopify and may use third-party apps or payment providers, personal data may also be processed by Shopify and other service providers as described in our Privacy Policy.


20. Force Majeure

We are not responsible for failure or delay in performing our obligations where caused by events outside our reasonable control, including natural disasters, strikes, transport disruptions, customs delays, supplier issues, war, pandemics, government restrictions, technical failures, or other force majeure events.


21. Complaints

If you have a complaint about an order or product, contact us first at:

Please include your order number and a clear description of the issue.

We will try to resolve complaints fairly and within a reasonable time.


22. Consumer Mediation

For French consumers, if a dispute cannot be resolved directly with us after a written complaint, you may have the right to use a consumer mediation service free of charge.


This section must be completed before publication once Wayke has selected an approved consumer mediator.


23. Applicable Law and Jurisdiction

These Terms are governed by the laws of France.

If you are a consumer located outside France, you may also benefit from mandatory consumer protections under the laws of your country of residence.

Nothing in these Terms limits your right to bring a claim before courts or authorities that are available to you under mandatory consumer protection laws.


24. Changes to These Terms

We may update these Terms from time to time.

The version applicable to your order is the version available on the website at the time you place the order, unless a later version is required by law.
